Terms of Service for SpaceCrashDummies

1. Acceptance of Terms

By downloading, installing, or using SpaceCrashDummies ("the App"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not download, install, or use the App.

These Terms constitute a legally binding agreement between you and Yahmir LLC ("Yahmir"). By creating an account through Google Sign-In, you further acknowledge your acceptance of these Terms.

2. Account Registration and Security

To access certain features of the App, including leaderboards and purchase restoration, you must sign in using Google Sign-On (SSO). You agree to:

Provide accurate and current information during the sign-in process
Maintain the security of your Google account
Immediately notify us of any unauthorized use of your account
Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

3. License Grant and Restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for personal, non-commercial entertainment purposes. You may not:

Modify, reverse engineer, decompile, or disassemble the App
Copy, distribute, or create derivative works of the App
Use the App for any commercial purpose
Remove, alter, or obscure any copyright, trademark, or proprietary rights notices
Use any automated systems or bots to access the App or manipulate gameplay
Exploit bugs or glitches for unfair advantage
Attempt to gain unauthorized access to our servers or other users' accounts

4. In-App Purchases

SpaceCrashDummies offers in-app purchases (IAP) that provide additional features, remove ads, or unlock premium content.

Purchase Terms

Payment: All purchases are processed through the Apple App Store or Google Play Store and are subject to their respective terms and conditions
Pricing: Prices are displayed in your local currency and may vary by region. Prices are subject to change without notice
Non-Refundable: All purchases are final and non-refundable except as required by applicable law or the app store's refund policy
Purchase Restoration: You can restore previous purchases on the same platform (iOS or Android) by signing in with the same Google account. Purchases do not transfer between platforms
No Transfer: Purchases are tied to your account and platform and cannot be transferred to other accounts or users

Available Purchases

In-app purchases may include but are not limited to:

Ad removal (permanent unlock)
Premium game features or modes
Cosmetic items or customization options
Bonus content or level packs

5. Advertisements

The App displays advertisements through Google AdMob. By using the App, you acknowledge and agree that:

Ads are a necessary part of the free version of the App
Ads may be personalized based on your interests and activity
You can remove ads through in-app purchase
We are not responsible for the content of third-party advertisements
Clicking on ads is at your own risk

6. Leaderboards and User Content

The App features leaderboards that display player usernames and scores publicly. By participating, you agree that:

Your username and scores will be visible to other players
You will not use offensive, inappropriate, or impersonating usernames
We reserve the right to remove or reset scores we determine to be fraudulent or achieved through cheating
We may moderate or remove inappropriate usernames without notice
Leaderboard rankings are provided "as is" without guarantee of accuracy

7. User Conduct

You agree to use the App responsibly and not to:

Violate any applicable laws or regulations
Cheat, hack, or use third-party tools to gain unfair advantages
Harass, abuse, or harm other users
Submit false scores or manipulate leaderboards
Use offensive or inappropriate language in your username
Attempt to interfere with the App's operation or other users' enjoyment
Impersonate others or misrepresent your identity

Violation of these conduct rules may result in account suspension or termination.

8. Intellectual Property

The App and all its content, features, and functionality (including but not limited to software, graphics, designs, text, logos, and gameplay mechanics) are owned by Yahmir LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The SpaceCrashDummies name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Yahmir LLC. You may not use such marks without our prior written permission.

9. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability, fitness for a particular purpose, or non-infringement
That the App will be uninterrupted, secure, or error-free
That defects will be corrected
That the App or servers are free of viruses or harmful components
The accuracy, reliability, or currency of any information in the App

Your use of the App is at your sole risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YAHMIR LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

Your use or inability to use the App
Any unauthorized access to or use of our servers and/or any personal information stored therein
Any interruption or cessation of transmission to or from the App
Any bugs, viruses, or malicious code transmitted through the App by any third party
Any errors or omissions in content or loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App
Loss of in-game progress, virtual items, or account data

IN NO EVENT SHALL YAHMIR LLC'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US IN THE PAST SIX (6) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

11. Termination and Suspension

We reserve the right to suspend or terminate your account and access to the App immediately, without prior notice or liability, for any reason, including but not limited to:

Breach of these Terms of Service
Fraudulent, abusive, or illegal activity
Cheating or manipulation of game mechanics
Violation of user conduct rules
Request by law enforcement or other government agencies

Upon termination, your right to use the App will immediately cease. Termination does not entitle you to a refund of any purchases. We reserve the right to delete your account data following termination, though some data may be retained as required by law.

12. Changes to the App

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the App.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the applicable arbitration rules, except that you may assert claims in small claims court if they qualify.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Yahmir LLC regarding the App and supersede all prior agreements and understandings.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect through:

In-app notification
Email to your registered email address
Update to the "Last Updated" date

Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.
